Often, the first - and perhaps only - time an insured actually looks at the written terms of his/her insurance policy is when a claim has been made, or, even more commonly, when a claim has been denied. Insurance policies - from standard residential policies to comprehensive commercial coverages - can read like a Gordian knot of phrases, terms and jargon…seemingly impossible to untangle. If your claim has been denied - or partially denied - you likely have received a letter from the insurance company citing verbatim all manner of exclusion and limitation language in your policy upon which the insurance company relies in denying your claim. The impression given is that the insurance company knows what it provides…and what it does not…and you are bound by their determination of coverage.

 

Fortunately, you are not bound by their interpretation of coverage. An insurance policy is essentially a contract and, as a contract, it is to be interpreted by a fair and reasonable reading of the wording and by legal principles established through court rulings. If there is vagueness, uncertainty or conflict in the language, the law in Tennessee favors the insured not the insurance company. We are experienced in handling coverage and loss issues on behalf of insureds, from residential claims to complex commercial coverages. We understand insurance policies and understand the insurance company does not always have the final word.
